Both sides rest in massive Palm Beach County DUI challenge

Seven judges now must decide whether to toss drunken-driving breath-test evidence in hundreds of cases after two days of evidence presented by defense attorneys and prosecutors.

The second day of the hearing saw the prosecutors respond to a challenge from defense attorneys looking to throw out breath machine evidence in some 400 cases.

DUI attorneys last year claimed that the Intoxilyzer 8000 used in Palm Beach County to test blood alcohol levels appears in some documents to have a slightly different filter than the model approved by the federal government, and therefore is inadmissible.
